Terms of Use

These Terms of Use (“TOU”) govern your access to and use of the website, content, CRM, campaigns, automations, and training provided by MavenRed d/b/a BluStar Digital Media. The TOU is incorporated by reference into our Terms of Service. If you do not agree, do not use the website or the Services.

1. Eligibility

You must be at least 18 years old to use this website or the Services.

If you use the Services to advertise, market, originate, or broker mortgage products, you represent that you hold all licenses, registrations, approvals, and authorizations required for your activities in the applicable jurisdictions, or that you are acting on behalf of a properly licensed mortgage broker, lender, banker, or other authorized mortgage business.

You also represent that you have the authority to accept these Terms on behalf of any business or organization you represent.

2. Acceptable Use

You agree not to use the website or Services to:

• Advertise, originate, broker, or solicit mortgage products in jurisdictions where you or the applicable mortgage business are not properly authorized or licensed.
• Publish or distribute deceptive, misleading, inaccurate, or unsubstantiated claims, including claims relating to mortgage rates, payments, APR, loan terms, approval likelihood, savings, government affiliation, or other material terms.
• Use the Services to send calls, text messages, emails, or other communications without the consent, authorization, disclosures, or other requirements applicable to those communications.
• Upload, collect, process, or use consumer or borrower information when you do not have the legal right or authorization to do so.
• Use the Services for unlawful discrimination, deceptive targeting, or practices that violate applicable fair-lending, fair-housing, consumer-protection, or other applicable requirements.
• Use the Services to facilitate unlawful referral fees, kickbacks, or other prohibited arrangements.
• Upload malware, attempt unauthorized access, interfere with the security or operation of the website or Services, scrape or misuse our systems, or attempt to reverse engineer technology or proprietary systems that you do not have the right to access.
• Copy, resell, redistribute, white-label, or commercially exploit BluStar's proprietary materials, systems, training, strategies, or intellectual property except as expressly permitted under the applicable Terms of Service.
• Submit or publish unlawful, fraudulent, harassing, defamatory, obscene, infringing, or otherwise objectionable content.
• Use the website or Services in a manner that violates applicable law, third-party platform rules, or these TOU.

3. Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through accounts or systems under your control.

You agree to provide accurate information and to promptly notify BluStar at team@blustardigitalmedia.com if you become aware of unauthorized access, misuse, or a security issue involving your account or information.

BluStar may restrict, suspend, or terminate access to the website or Services where reasonably necessary to protect the website, Services, users, systems, or intellectual property, or where you violate these TOU or applicable law.

Any suspension or termination under this section does not create a refund right except where expressly provided in the applicable Terms of Service.

4. Intellectual Property

The BluStar Digital Media website, including its branding, logos, original copy, graphics, educational materials, videos, software, proprietary systems, templates, frameworks, methodologies, processes, training materials, scripts, and other materials provided by BluStar are owned by BluStar or its licensors and are protected by applicable intellectual property laws.

Your rights to use any client-specific campaigns, funnels, forms, surveys, workflows, automations, qualification systems, creatives, lead data, or other deliverables created specifically for you are governed by the applicable Terms of Service.

Nothing in these TOU transfers ownership of BluStar's underlying strategies, frameworks, methodologies, reusable systems, automation logic, prompts, processes, know-how, templates, or other proprietary intellectual property.

You may not copy, sell, license, redistribute, white-label, publish, or commercially exploit BluStar's proprietary intellectual property except as expressly permitted under the applicable Terms of Service.

5. User Submissions and Feedback

If you submit a testimonial, review, comment, image, suggestion, feedback, or other content to BluStar, you represent that you have the right to provide that content and that it is accurate and not misleading.

By submitting content for public or promotional use, you grant BluStar permission to use, reproduce, display, and publish that content for marketing, promotional, educational, or business purposes without additional compensation, unless otherwise agreed in writing.

You may contact us if you believe submitted content has been used incorrectly or without appropriate authorization.

6. Earnings and Results Disclaimer

The information and content provided through this website are intended for general informational and educational purposes and should not be considered legal, compliance, tax, lending, financial, or other professional advice.

BluStar Digital Media is a marketing and technology provider. BluStar is not a mortgage lender, mortgage broker, loan originator, attorney, or legal/compliance advisor.

Examples, case studies, testimonials, appointment volumes, lead volumes, loan results, or other performance figures presented on the website are provided for illustrative purposes only and are not guarantees of future results. Actual results may vary substantially based on factors including market conditions, competition, advertising-platform performance, borrower demand, loan products, licensing, Client follow-up, pricing, and other factors outside BluStar's control.

Any express performance commitment or limited refund applicable to a Client is governed solely by the applicable Terms of Service and its stated eligibility conditions.

7. Third-Party Sites and Products

The website and Services may contain links to or integrations with third-party websites, platforms, software, advertising networks, CRM systems, communication providers, payment processors, hosting providers, and other third-party services.

These third-party services are governed by their own terms, policies, pricing, and privacy practices.

BluStar does not control and is not responsible for third-party services, including their availability, pricing changes, outages, account restrictions, policy changes, technical issues, or security incidents occurring outside systems under BluStar's reasonable control.

8. Disclaimers and Limitation of Liability

The website and Services are provided on an “as is” and “as available” basis to the maximum extent permitted by applicable law.

Except for any express obligations specifically stated in an applicable Terms of Service agreement, BluStar does not warrant that the website or Services will be uninterrupted, error-free, secure, or suitable for every particular purpose.

BluStar will not be liable to the maximum extent permitted by applicable law for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, including loss of revenue, commissions, business opportunities, goodwill, or expected savings.

Any applicable limitation of liability and other contractual remedies are governed by the applicable Terms of Service.

9. Indemnification

You agree, to the extent permitted by applicable law, to defend, indemnify, and hold harmless BluStar Digital Media, MavenRed, and their owners, employees, contractors, and service providers from claims, liabilities, damages, losses, penalties, and reasonable expenses arising from:

• Your breach of these TOU or the applicable Terms of Service;
• Your violation of applicable law or regulation;
• Your products, services, mortgage programs, offers, disclosures, or business practices;
• Information, content, or data supplied by you;
• Your misuse of the website or Services; or
• Your unauthorized use of third-party systems or information.

10. Governing Law; Dispute Resolution

These Terms of Use shall be governed by the laws of India.

The parties will first attempt in good faith to resolve any dispute, claim, or disagreement arising out of or relating to these TOU through direct discussion.

If the dispute cannot be resolved through good-faith discussions, the parties will attempt to resolve the matter through mediation.

If the dispute remains unresolved following mediation, it will be resolved through binding arbitration in India in accordance with applicable Indian arbitration law, subject to any mandatory requirements of applicable law.

For Clients with an executed Terms of Service agreement, the dispute-resolution provisions of that agreement will also apply to the extent applicable.

11. Changes

BluStar may update or modify these Terms of Use from time to time. Updated versions will be posted on this website with a revised “Last Modified” date.

Changes will apply prospectively from the effective date stated in the updated TOU, except where a different treatment is required by applicable law.

Your continued use of the website after an updated version becomes effective constitutes acceptance of the revised TOU.

Nothing in an updated website TOU will automatically amend or override an executed client agreement unless the applicable client agreement expressly permits such modification.
