Terms of Use

These Terms of Use (“TOU”) govern your access to and use of the website, content, CRM, campaigns, automations, and training provided by BluStar Digital Media. The TOU is incorporated by reference into our Terms of Service. If you do not agree, do not use the website or the Services.

1. Eligibility

You must be at least 18 years old and, if you are using the Services to market mortgage products, you must hold all required licenses or be an employee or authorized agent of a licensed mortgage broker, banker, or lender. You represent that you have the authority to bind any organization on whose behalf you act.

2. Acceptable Use

You agree not to use the website or the Services to:

• Advertise, originate, broker, or solicit mortgage loans in any state where you are not properly licensed;
• Publish deceptive, misleading, or unsubstantiated claims about rates, payments, APR, terms, approval odds, government affiliation, or savings, or omit required disclosures, NMLS identifiers, or Equal Housing Opportunity notices;
• Send calls, texts, ringless voicemails, or emails without the consent required by the TCPA, state mini-TCPA statutes, Do-Not-Call rules, or CAN-SPAM;
• Upload or process consumer data you do not have the legal right to use, or use the Services as a consumer reporting agency or for any FCRA-permissible purpose;
• Engage in discriminatory targeting or exclusion on the basis of any protected class, or otherwise violate ECOA, the Fair Housing Act, or fair lending rules;
• Offer or accept referral fees or kickbacks in violation of RESPA Section 8;
• Upload malware, attempt to gain unauthorized access, scrape, reverse engineer, resell, white-label, or share access to the Services or our scripts, campaigns, funnels, and training with any third party;
• Post unlawful, fraudulent, harassing, defamatory, obscene, or infringing content; or
• Interfere with the operation, security, or integrity of the website or the Services.

3. Accounts and Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at team@blustardigitalmedia.com of any unauthorized use. We may suspend or terminate accounts that violate this TOU without notice or refund.

4. Intellectual Property

All content on this website and inside the Services - including copy, scripts, campaign assets, funnels, workflows, training videos, logos, and the BluStar Digital Media name - is owned by us or our licensors and protected by intellectual property laws. You receive a limited, revocable, non-transferable license to use these materials for your own business only. You may not copy, resell, redistribute, coach from, or create derivative works from them.

5. User Submissions and Feedback

Any testimonial, review, comment, image, or other content you submit may be used by us for marketing purposes without compensation. You represent that you own or have the rights to any content you submit and that it is accurate and not misleading.

6. Earnings and Results Disclaimer

All content is for educational and general informational purposes only. BluStar Digital Media is a marketing and technology company and is not a lender, mortgage broker, or licensed loan originator. We do not provide legal, compliance, tax, or lending advice. Any closed loan counts, volume figures, case studies, or testimonials shown are not typical, are not a guarantee, and depend on your market, licensing, pricing, follow-up speed, and effort. Your results may be lower or zero.

7. Third-Party Sites and Products

The website and Services may link to or integrate with third-party products, including Meta, Google, CRM, telephony, and email providers. Those products are governed by their own terms, and we are not responsible for them.

8. Disclaimers and Limitation of Liability

The website and Services are provided “as is” and “as available” without warranties of any kind. To the fullest extent permitted by law, we disclaim all implied warranties and are not liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits or commissions. Our aggregate liability is limited as set out in our Terms of Service.

9. Indemnification

You agree to indemnify and hold harmless BluStar Digital Media, its officers, members, employees, and agents from any claims, losses, or expenses (including attorneys’ fees) arising from your use of the website or Services, your content, or your violation of this TOU or any law.

10. Governing Law; Arbitration

This TOU is governed by the laws of the State of Wyoming. Disputes are resolved by binding individual arbitration seated in Sheridan County, Wyoming, under the AAA Commercial Arbitration Rules, with a waiver of jury trials and class actions, as described in our Terms of Service.

11. Changes

We may amend this TOU at any time. Amendments are effective on posting, and your continued use of the website or Services constitutes acceptance.
